1- General
The general terms and conditions of sale set out below govern all sales, resales and other transactions involving products distributed by URBAND, regardless of the purchaser's documents.
2- Warranty
URBAND guarantees the products it distributes for a period of twenty-four (24) months from the date of delivery against all manufacturing defects and for normal use of the products. The purchaser must send URBAND proof of purchase of the defective product within one week. If the product is not guaranteed, a temple will be invoiced at 25% of the current price excluding VAT of the frame and the front will be invoiced at 50% of the current price excluding VAT.
3- Delivery times
Delivery times are given as an indication only. The purchaser may not cancel an order on the grounds of late delivery or claim damages. The buyer accepts the possibility of partial delivery.
4- Prices
The prices indicated when the order is placed are firm and definitive.
5- Terms of payment
All invoices are payable in full within 30 days of the invoice date. Any payment within 8 days of the invoice date will entitle the purchaser to a 2% discount. The purchaser will then be authorised to deduct the discount from the amount of the invoice including VAT at the time of payment. Any delay in payment on the due date of the invoice or any payment incident will result in the application of default interest of two per cent (2%) per month of delay.
6- Reservation of ownership
The buyer is responsible for the goods in the event of theft, loss or destruction until full transfer of ownership, which will take place only after full payment of the goods (including costs and accessories). In the event of non-payment of the goods on the due date, URBAND reserves the right to reclaim them. A registered letter will be sent to the buyer.
7- Return of goods
All complaints must be made in writing within 8 days of receipt of the goods by the buyer. After this period, the delivery is considered to have been accepted by the buyer. After this period, no goods may be returned without the written agreement of URBAND.
8- Return of goods for exchange
No goods may be returned without the written agreement of the URBAND sales department. No returned goods will be accepted if they are not accompanied by an order, and if they are not returned in their original packaging (labelled + presentation glasses), new and without scratches, otherwise the return of goods will be refused.
A photocopy of the original invoice must be provided and the quantity of glasses returned may not exceed 1 in 4 of the new order. Example: 12 frames purchased up to 3 returns accepted, with the following conditions:
For models still in the collection purchased in the six (6) months preceding the return, a 30% discount will be applied. For models purchased between the 6th and 12th month prior to the return, a 50% discount will be applied. After 12 months, no glasses will be taken back.
9- Credit notes
Credit notes are valid for 24 months from the date of issue. They are granted in the form of a credit note only, to be used through the individual URBAND customer account.
10- Transport of goods
Shipping costs are at the buyer's expense. Goods travel at the buyer's risk.
11- POS
The URBAND company may decide to supply the buyer with posters, displays, brand reminders, signs or any other advertising elements which remain the exclusive property of the URBAND company. This POS advertising must be used in normal conditions of use and for the products of the brand in question. The buyer must return it at his own expense at the request of URBAND.
12- Protection of trademarks
The buyer may not use the trademarks distributed by URBAND without the latter's express agreement.
13- Reservation of jurisdiction
Any dispute will be subject to the jurisdiction of the Toulon Commercial Court.
